Public Information Act Requests

Texas Government Code 552.002(a) defines “public information” as information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business by a governmental body, or for a governmental body if the government body owns the information or has a right of access to it.

Public information may be requested from Leander ISD via the Legal Services Department. It is important to note that Governmental bodies are not required to, perform legal research, or comply with a continuing request to supply information on a periodic basis as such information is prepared in the future, answer questions however, if available, records that would provide the answers to posed questions will be provided if not excepted from release via statute.

Leander ISD Legal Services department works with campuses and departments to ensure legal compliance with state and federal laws, rules, regulations and board policies. Leander ISD upholds the principles of Open Government and complies fully with the Texas Public Information Act.

How to Request Public Information

Your request must be in writing and addressed to Leander ISD, Att.: Public Information. Only written requests trigger a governmental body’s obligations under the Public Information Act.

Additional instructions when submitting a request

  • Provide your full name and contact information including email/or fax (if available).
  • It is helpful to clearly label your correspondence as a “Public Information Request”.
  • Provide a detailed, precise description of the nature and scope of information you are seeking. The more specific the request, the fewer clarifications will be needed to fulfill your request.
  • Requests must be for documents or other information that is already in existence.

Common Public Information Requests

Requests for Emails:

In order to conduct a search for emails, the following information must be provided:

  • Full and Correct spelling of the LISD staff member’s name that emails are being requested for;
    • Specific time period (e.g., December 1, 2013-January 31, 2014);
    • Specific search terms (emails between Jane Doe and John Q. Public)
    • Specific Topic

Student List Request:

Student directory information can only be released pursuant to Board Policy FL(LOCAL). For student list requests, always include the school names(s) and grade level(s) desired. 

  • The standard fields provided in Student Lists are as follows:
    • Student Name
    • Address
    • Phone
  • The information provided is ONLY for “unrestricted” students
  • Student Lists are provided in Excel Format via Email, unless the document is too large in which case the data will be provided on a USB via U.S. Mail for an additional cost. 

Employee List Request:

In the instances where the employee has restricted access to their address and phone in accordance with Section 552.024 of the Texas Public Information Act, the address and phone fields will be EMPTY and all other fields of the information provided. 

  • The standard field provided in Employee Lists are as follows:
    • Name
    • Department/Campus
    • Job Code Description
    • LISD Email
    • Address
    • Phone
    • Hire Date 
  • Lists are provided in Excel format via email, unless the document is too large in which case the data will be provided on a USB via U.S. Mail for an additional cost. 

Retiree List Requests: 

For retiree list requests, always include the date range desired. 

  • The standard field provided in Employee Lists are as follows:
    • Name
    • Department/Campus
    • Job Code Description
    • Address
    • Phone
    • Hire Date 
    • Years of Service 
  • Retiree lists do not include address and phone number for retirees who have elected to opt-out of the disclosure of personal information. 
  • Lists are provided in Excel format via email, unless the document is too large in which case the data will be provided on a USB via U.S. Mail for an additional cost.

Bid Tab Request:

  • Always include the RFP Project Number and description of the project when requesting bid tabulation for a project.
  • Documents responsive to requests for bid proposals may contain third party information, which could require an Attorney General ruling request. If that is the case, you will be notified in writing.

What to Expect After Making a Request

Once your request is received by Leander ISD Legal Services, you will receive an email acknowledging receipt of your request. If you do not receive an acknowledgment that your request has been received, then Leander ISD Legal Services has not received your request.

The Texas Public Information Act provides that a governmental body must “promptly” produce public information in response to your request. “Promptly” means that a governmental body may take a reasonable amount of time to produce the information, which varies depending on the facts in each case. The amount of information you have requested is highly relevant to what makes for a reasonable response time under the Act.

Due to the volume of requests received, Leander ISD’s Legal Services has a typical turnaround time of ten business days. In the event processing of your request will take longer than ten business days, Leander ISD Legal Services will notify you of the projected time frame for completion.

The Texas Public Information Act allows a governmental body to recover costs relating to reproducing public information. Additionally, a request for copies that results in more than fifty pages may be assessed charges for labor, overhead, and materials. If the estimated charges will exceed $40.00, you will receive an itemized statement of estimated charges before any work is undertaken.

The following is a partial list of charges for copies of public information, as adopted by the General Services Commission:

  • Standard paper copy–$.10 per page
  • Oversized Paper copy–$.50 each
  • USB drive – $6.00
  • Other–Actual cost
  • Labor charge: For programming–$28.50 per hour
  • For locating, compiling, and reproducing–$15 per hour
  • Overhead charge–20% of labor charge
  • Miscellaneous supplies–Actual cost
  • Postage and shipping charge–Actual cost

If information you have requested may be confidential pursuant to the Texas Public Information Act, Leander ISD’s Public Information Office must:

Seek an attorney general decision within ten business days of its receipt of your request stating the exceptions to disclosure that it believes are applicable and send you a copy of its letter to the attorney general requesting a decision within ten business days.

Send the attorney general its arguments for withholding the information you requested and copies of the information you have requested within fifteen business days of receiving your request. You are entitled to receive this notice; however, if the letter to the attorney general contains the substance of the information requested, you may receive a redacted copy of the letter.

Board Adopted Non-Business Days

The Texas State Legislature has defined “business days” as any day that is not a Saturday, Sunday, national holiday, state holiday, or certain optional holidays. Texas House Bill 3033 allows school boards to designate up to 10 days as Non-Business Days in a calendar year to afford the district the ability to efficiently respond to requests and meet timelines and requirements pursuant to the Texas Public Information Act.

Nondiscrimination Policy

The following information is provided in response to 34 C.F.R. Part 106.8 of the 2020 Title IX Regulations, mandating notice of a nondiscrimination policy and adoption and publication of grievance procedures that provide for the prompt and equitable resolution of student and employee complaints. In accordance with Title IX, the district does not, and is required not to, discriminate on the basis of sex in its educational programs or activities. The requirement not to discriminate extends to employment. As a school district serving students in kindergarten through grade 12, the district is not subject to provisions in Title IX Regulations (Subpart C) prohibiting discrimination on the basis of sex in admissions and recruitment. However, the district does not discriminate on the basis of sex in admissions or transfer requests.

The district has designated and authorized the following employees as the Title IX Coordinators to address concerns or inquiries regarding discrimination on the basis of sex, including sexual harassment, sexual assault, dating violence, domestic violence, stalking, and gender-based harassment: 

Any individual may report sex discrimination, including sexual harassment, at any time, including during non-business hours, by mail, phone, or email. 

During district business hours, reports may also be made in person.

Upon receiving an allegation of sex-based harassment, the Title IX Coordinator will promptly respond in accordance with board policies FFH and DIA.

Inquiries about the application of Title IX may be referred to the district’s Title IX Coordinator, to the Assistant Secretary for Civil Rights of the Department of Education, or both.

Policy

Board Policy

Leander ISD’s Board of Trustees (school board) sets the policies by which LISD operates. Much public school policy is set by state and federal law and listed within the Texas Education Code. These “Legal” policies and a set of corresponding “Local” policies make up the Leander ISD Policy Manual, available online for all parents and community members.

Check Policy

Checks written to the school or any school organization must include on the front of the check the driver’s license number and a valid telephone number. Post-dated and temporary checks are not accepted.

In the event that a check written to any Leander ISD campus, club, or organization is returned unpaid by a bank, Leander ISD or its agent will redeposit your check electronically. Additionally, Leander ISD may electronically collect a returned check fee of $30.00 plus applicable sales tax. This fee is in addition to any fees your bank may charge. The use of a check for payment is your ACKNOWLEDGEMENT AND ACCEPTANCE of this policy and its terms.
